Age of consent...

Young teacher, the subject
Of schoolgirl fantasy
She wants him so badly
Knows what she wants to be
Inside her there's longing
This girl's an open page

This girl is half his age

I don’t usually comment on these things, but listening to someone say: ‘You just have to look at him to see he’s a pedo; he should be hung’, really raised my hackles… and by the way stupid that should be ‘hanged’.

Obviously it isn’t great when a young woman runs off with her teacher; it’s probably upsetting for her parents and means the end of his career too I expect. And no, I wouldn’t be happy if my daughter or son were in either of those positions. But it isn’t new, we don’t have the full background, it certainly doesn’t warrant hanging and I for one question if he deserves any punishment at all. Now, there will be some of you out there that brand me a pervert for this, but let’s start by looking at a few facts about the age of consent.

Anne Bolyne married Henry VIII at 12, and yes I know that was a long time ago.
Shakespeare’s Juliet was just 13 (yes I know, she’s a fictional character), but before 1875, in my grandmother’s lifetime, the AOC was just 12 in the UK.

Up until 2002 it was 14 in Russia.
In the USA it was 10 until 1900.
Today in Austria, Italy, Germany, and China it’s 14.
France and Denmark it’s 15.
Most of Eastern Europe it’s 14.
Spain and Japan it’s 13.
In Angola it’s 12 and in Tunisia it’s 20, almost on the shelf then by Japanese standards.

Outraged? Bear with me.

Seems to me that the age of consent is just a number grabbed from the air and I’m sure that we all know some very mature teenagers and some incredibly immature thirty year olds (like the female who made the ‘hang the pedo’ comment). Incidentally up until the Victorian times gay sex was punishable by death; I expect that she'd have thought that a good idea too.

I don’t know where the line should be drawn on consent. I’m very intolerant of paedophilia and think that paedophile’s should severely punished, it’s the worst of crimes, but drawing that line is so hard to gauge. In Portugal they make a judgement call; although the age of consent is 14, the legality of sexual acts with a minor between 14 and 16 is open to legal interpretation since the law states that it is illegal to perform a sexual act with an adolescent between 14 and 16 years old "by taking advantage of their inexperience". I’ll leave you to decide what inexperience means.

Of course the age of consent doesn’t apply as yet in this latest tale, we don’t know if the couple have had sex or not, and why should we? What business is it of ours? Besides, most (yes most, and 32% even admit to it) teenagers in the UK have sex before the UK legal age of consent of 16, perhaps a case for lowering it?

Maybe it’s the age difference that causes such outrage and those silly calls to ‘hang him’ from those very stupid people. Well, she’s almost 16 and he’s a young-minded 30. Is 14 years really such a difference? I know couples with 14 years between them, and so what? Since when did a forty-five year old man going out with a thirty-one year old woman cause any fuss at all? It’s not always the same for the woman/man ratio though; especially in the eyes of other women, something I’ve never been able to understand.

Apart from being very silly, maybe falling in love, betraying trust, running away – as lovers often do – has anyone really done anything wrong? Well, he is (was) a teacher. So would it have been okay if he was a builder? Well, he did abduct her. What bundled her up, gagged her, and drove her to a lock-up somewhere? I thought they went to Paris on a bit of a jaunt. Did he beat her up then? Was he disrespectful to her? Was him coming back, pretty much of his own free will, just some cynical ruse?

And what about the reasons behind it all – Were they happy at home? Was her relationship with her stepfather a good one? Was he happy with his wife?

Listen, I don’t think, although I can’t be sure, that either one has done anything really wrong. She’s not 16 but neither is she twelve and I don’t think this will turn out to be a paedophile grooming story. As for the rest, well only time will tell. The only thing that I am sure of is that he shouldn’t be hanged regardless of what he's done and particularly if his only crime is falling for the wrong right girl.

Hang me if you like.

    Linda Kemp No hanging, but it does make a difference that he is a teacher, there are responsibilities about being "in loco parentis" and we need to be able to trust those wh are in that position. Same with doctors, priests, scoutmasters, etc. Power is attractive to females; that attraction can eaily get confused with love.....

    Andrew Height Linda, yes I recognise that and you are right. Even so he won't be a teacher again and on Radio 4 today I listened to a couple who were in just this position. They are still together 30 years later, happy but they wouldn't be pleased with this happening to their children either. My points are, having a relationship with a young woman isn't wrong and the age of consent is nonsense. He deserves to lose his job, but not to be pilloried and he certainly should not go to prison. Now Jimmy Saville... that is quite a different matter. Such a pity he is dead.

    Andrew Height I used to read the Daily Mail, and then one day I realised that I was believing what I was reading. Mind you, I used to buy the Sun and the Independent and I believed them too. These days I watch the BBC in the knowledge that they are iimpartial... looks like I was wrong about them too.

    Kevin Parrott Oh, you can read what you choose, but don't have to believe what you read. After all you did go to Grammar School, so you would have been taught that.
    However just recently, I've been worried about the Daily Mail, and The Mail on Sunday.
    Both appear to be lurching to the left.
    They used to be our first line of defence against the socialist Hun.

    Suzy Swift The age of consent is irrelevant really. Teachers can be jailed and made to sign the sex offenders' register for having relationships with pupils over 16. The trust thing bothers me.... Maybe they are in love but I doubt it.... She is 15 and, determined as I'm sure she was to get what she wanted, he should have been there to protect her, not least from herself.....

    Richard Shore I always find it interesting that (most) people think they can devine the thoughts of others. Their decisions were made in the context of their lives, which they live within the context of society. If we reduce the world to black and white hang em high decisions we can forget that we made that society.

    Andrew Height No, I can't Linda. But I didn't say it wasn't wrong Kerry Of course it's wrong, after all he signed up not to do this as a teacher, but he doesn't deserve prison or going onto the sex register probably. In fact in Europe the teacher sex register thing doesn't apply. We blindly react and act like puppets based around some governmental made up code, we are fed what to believe. When will we start thinking for ourselves?

    Philip Heslehurst Hmm everyone seams to focus on the sexual relationship which may or may not have happened. Almost certainly he has committed the offence of child abduction This is what is called an either way offence which means it can be tried in magistrates or crown court with maxium sentence of 6 months in mags or 7 years in crown. Both mitigating and aggravating factors will be considered such has how he has treated her, mitigating, and position of trust aggravating. These are the shades of grey that surround our black and white laws. Any abuse of trust sexual offences will almost certainly need evidence from the girl which may not be forthcoming. Should he be sent to jail if found guilty of child abduction as a farther I would say yes. Should he be hanged of course not. Laws are made to protect socicety especially the vulnerable members of society such as 15 year old girls.

    Andrew Height Actually, thinking about it I can't. If the European Parliament decided tomorrow that the age of consent was 15 this man would have no abduction case to answer to Phil. When will you blue-uniformed lot start thinking for yourselves? If you don't know where the unfriend button is I'm sure your manual will tell you. ;-)

    Andrew Height Sorry if you don't agree, but as it stands I don't think that teacher Jeremy Forrest has much to answer for other than being very silly for falling for Megan Stammers.

    Of course, time may well prove me wrong about that. But, either way, the age of consent is such a nonsense.

    Philip Heslehurst Of course then it wouldn't be a crime. However then a teacher takes a 14 year old and so it goes on. I would not unfriend anyone for having an opinion that I didn't agree with I may not agree with what you say but I defend your right to say it.

    Age is just a number. The runaway two are in love, in a relationship, care for each other, whatever you want to call it. The law shouldn't be black and white - 15 years - have you listened to 15 year old girls discussing love, sex,passion? There is never a mention of age in the equation. At 12 I was in love with Elvis - 21 years my senior, I din't think he was old just lovely and my dreams were romantic rather than sexual. At the same time my school pal had a child - pregnant at 12, fully developed and in love with her boyfriend. She went on to marry him and had more children. All the music videos are overtly sexual, they aren't aimed at us oldies - they are made for the teen market, 30 years ago they would have been classed as explicit. So judge ye not - none of us know what went on and we don't need to, but the same people who are shouting out about peodos are the same ones who will buy the newspapers to read the salacious details.
